Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website at fenridgeview.xyz (the "Website") or engaging the services operated by FenridgeView Photography ("us", "we", "our").

Your access to and use of the Website and our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and clients who access or use the Website or our photography services.

By accessing or using the Website or our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Website or use our services.

1. Website Use

1.1 Content

All content on the Website, including but not limited to photographs, images, text, graphics, logos, and software, is the property of FenridgeView Photography or its content suppliers and is protected by United Kingdom and international copyright laws.

1.2 License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website for personal, non-commercial purposes. This license does not include:

• The right to modify, reproduce, distribute, or sell any content from the Website
• The right to use data mining, robots, or similar data gathering methods
• Any use of the Website or its content other than for its intended purpose

1.3 User Accounts

When you create an account on our Website, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

1.4 Prohibited Conduct

When using our Website, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others or violate their privacy

2. Photography Services

2.1 Booking and Scheduling

All photography bookings are subject to our availability. A booking is confirmed only when:

• You have received a written confirmation from us
• The deposit payment has been received (where applicable)
• A signed contract has been returned (for certain services)

2.2 Deposits and Payments

For most photography services, we require a non-refundable deposit at the time of booking to secure your date. The deposit amount will be specified in your booking information. The remaining balance is due according to the payment schedule outlined in your contract or booking confirmation.

Acceptable payment methods include credit/debit cards, bank transfers, and other methods specified at the time of booking.

2.3 Cancellations and Rescheduling

Our cancellation policy is as follows:

• Cancellations made more than 30 days before the scheduled session: Deposit is non-refundable, but may be applied to a future session within 6 months
• Cancellations made 15-30 days before the scheduled session: 50% of the total fee is due
• Cancellations made less than 15 days before the scheduled session: 100% of the total fee is due

Rescheduling requests are subject to our availability and may incur additional fees if made less than 15 days before the scheduled session.

2.4 Service Delivery

We strive to provide our services as described and in a professional manner. However, photography is an art form and subject to our creative interpretation. We cannot guarantee specific shots or styles beyond what is reasonable within our advertised portfolio and style.

The number of final edited images will vary depending on the service package chosen, duration of the session, and other factors. The approximate number of images will be specified in your service agreement.

2.5 Delivery Timeframes

Typical delivery timeframes for our services are:

• Portrait sessions: 2-3 weeks
• Weddings and large events: 4-6 weeks
• Commercial projects: As specified in the contract

These timeframes are estimates and may vary during peak seasons or due to unforeseen circumstances.

3. Copyright and Image Usage

3.1 Copyright Ownership

All photographs created by FenridgeView Photography remain our intellectual property. Copyright is not transferred to the client unless explicitly stated in a written agreement and may be subject to additional fees.

3.2 Client Usage Rights

When you purchase our photography services, you receive a license to use the delivered images for personal, non-commercial purposes. This typically includes:

• Printing for personal display
• Sharing on personal social media accounts with attribution
• Using in personal communications (e.g., holiday cards)

Commercial use, including but not limited to advertising, marketing, or sale of the images, requires a separate commercial license agreement.

3.3 Photographer's Portfolio Rights

We reserve the right to use any photographs taken during our services for our portfolio, website, social media, contests, art exhibitions, promotional materials, and other business-related purposes, unless otherwise specified in writing.

If you prefer that your images not be used for these purposes, please discuss this with us before your session.

4. Product Purchases

4.1 Print Products

All print products (including albums, prints, canvases, etc.) are subject to our current pricing at the time of order. Due to the custom nature of these products, all sales are final once production has begun.

4.2 Digital Products

Digital products and downloads are non-refundable once delivered. We make every effort to ensure the quality of our digital files, but cannot guarantee compatibility with all devices or software.

4.3 Shipping

Physical products will be shipped to the address provided at the time of order. We are not responsible for delays or delivery issues caused by the shipping carrier. Shipping costs are non-refundable.

5. Limitation of Liability

To the maximum extent permitted by law, FenridgeView Photography shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Website or our services
• Any conduct or content of any third party on the Website
• Any content obtained from the Website
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims under these Terms shall not exceed the amount you paid us for the applicable service or product.

6. Equipment Failure and Force Majeure

While we take reasonable precautions to prevent equipment failure, in the event of camera, memory card, or other technical failure, or photographer illness/injury, our liability is limited to a refund of payments made or re-scheduling at a mutually agreeable time, where possible.

We are not liable for failure to deliver services due to causes beyond our reasonable control, including but not limited to: acts of God, fire, flood, earthquake, war, governmental actions, labor disputes, or power/equipment/venue failures.

7. Indemnification

You agree to defend, indemnify, and hold harmless FenridgeView Photography and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Website and our services
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our Website with the effective date. By continuing to access or use our Website or services after those revisions become effective, you agree to be bound by the revised terms.
